We respond to your enquiry

You will be contacted by our team who will carry out an initial assessment of your mortgage sale. They may proceed with a claim based upon the information you provide. To do this we require your authority. You will be sent a claim pack, which details your claims process. Upon receipt of your signed authority and any supporting documentation, we may make a Subject Access Request (SAR) to obtain documentation relating to your mortgage sale and its subsequent management. This typically takes 5 weeks. (Some responses are more prompt)

FREE ‘mortgage audit’

Upon a response to the SAR, all relevant documentation will be audited FREE of charge by an expert in the compliant sale of a mortgage. This audit will identify any breaches or ‘failings’ of mortgage regulation which may constitute a mis-sold mortgage. These ‘failings’ will be indentified by referring specifically to the MCOB regulation introduced by the FSA in 2004.

“Failings” we make a complaint

A letter of complaint is produced (LOC) for submission. This will include your estimated loss. The LOC is a comprehensive representation of your claim and the facts which support it. Our team will ensure that the LOC is acknowledged by the recipient and acted upon. There is a maximum timescale allowed of 8 weeks in which to respond. If your claim is upheld we will pursue your compensation, in the event that it is not, our claims team will consider the next course of action to be taken, you will be advised accordingly. It is possible that legal action may be recommended without your case being referred to the FOS.
